On February 21, 2018, the jury rendered a full defense verdict for GED’s clients in a highly contentious retrial. The plaintiffs claimed that GED’s client breached a settlement agreement that resulted in the plaintiffs sustaining losses of sales commissions for the rest of the individual’s working life.

The case was originally tried by another law firm. In that first case, the jury returned a verdict for the plaintiffs on all three of plaintiffs’ claims for breach of contract, intentional interference with contractual relations, and intentional interference with prospective economic advantage. The jury awarded the plaintiffs $4.2 million.

Marc Eisenhart was first retained after the first jury verdict. Marc’s successful post-trial motions led to judgment in the client’s favor on the two interference claims, and a new trial on the breach of contract claim.

GED obtained an order to conduct the breach of contract re-trial in phases. GED won the trial’s first phase seeking reformation of a portion of the settlement agreement. The subsequent jury phase resulted in a full defense verdict for GED’s client.
