Marc Eisenhart successfully argued for a new trial for the defendant client. The trial concerned money that plaintiff transferred to the defendant, or paid for her benefit, for defendant’s attorney’s fees and property settlement in connection with the defendant’s dissolution of marriage action. The defendant was represented by a different law firm in the trial. The jury determined the plaintiff’s damages to be $0 for breach of contract and $156,000, for the cause of action of money paid.
Gates Eisenhart Dawson was retained following the verdict. On December 22, 2017, the trial court granted Marc Eisenhart’s motion for a new trial as to the issue of damages because there was no possibility of reconciling the determinations of the amount of damages since they were based on the same evidence.
